NEW DIVORCE LAWS SET TO LESSEN PROPERTY BURDEN FOR SEPARATING COUPLES

Are you going through a divorce? Worrying about your property and what happens next? Things have just got a whole lot easier courtesy of the biggest shake up in divorce law for more than half a century.

Previously some kind of blame would need to be apportioned i.e. adultery or unreasonable behaviour, for any divorce proceedings to be carried out. Even then, the process could drag on for two years and in some cases, even five.

But no longer, with the Divorce, Dissolution and Separation Act (2020) completely ending the need for that “blame” to be made… you now don’t have to point the finger to take the ring off your finger.

Instead the new act introduces a 20-week time frame from the start of proceedings to when an individual may apply for a conditional order of divorce. 

The purpose of that 20-week period? To provide time for reflection and preparation for the future, including living arrangements, children and finance. 

In 2020, the Office for National Statistics reported that there was 103,592 divorces granted in England and Wales, and with 42% of married couples expected to get divorced (ONS), these law changes are more important than many may think.
